Terms of Service

SharkyPOD Monitor

SharkyPOD Monitor is a service operated by Enlightened by Design LLC.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("subscriber," "you," or "your") and Enlightened by Design, LLC, a limited liability company ("we," "us," or "our"), governing your access to and use of SharkyPOD Monitor (the "Service").

By subscribing to or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not subscribe to or use the Service. These Terms constitute the entire agreement between you and Enlightened by Design LLC with respect to SharkyPOD Monitor and supersede all prior agreements, representations, and understandings.

1. The Service

SharkyPOD Monitor is an automated inventory monitoring service provided by Enlightened by Design LLC that connects to your Printify account via Printify's official API and monitors your product catalog for changes in variant availability on a scheduled basis, approximately every 6 hours.

How the Service Works

Upon subscribing, you will complete a brief onboarding process providing your Printify Personal Access Token created with exclusively read-only permissions. These credentials are used exclusively to access your Printify product catalog data on your behalf. Your catalog is checked automatically on a recurring schedule. When a change in variant availability is detected, an email notification is sent to the email address provided during onboarding.

Service Availability

SharkyPOD Monitor is provided as-is and is subject to the limitations described in Section 3 of these Terms. The service is dependent on the availability of Printify's API and third-party infrastructure. Scheduled monitoring may be delayed or temporarily unavailable during periods of maintenance or technical disruption.

Relationship to Printify

SharkyPOD Monitor is an independent service created by Enlightened by Design LLC. It is not affiliated with, endorsed by, or officially partnered with Printify. Use of this service is subject to Printify's own Terms of Service and API Terms, which you are responsible for reviewing and complying with independently.

2. Your Responsibilities

Account Credentials

To use SharkyPOD Monitor, you must provide a valid Printify Personal Access Token. You are responsible for ensuring these credentials are accurate and provide only the access level necessary to monitor your shop. If your Printify API token expires, is revoked, or is replaced, the monitoring service will cease to function until updated credentials are provided. Enlightened by Design LLC is not responsible for missed, delayed, or failed alerts resulting from expired, incorrect, or revoked credentials.

Credential Security

Your Printify API token grants access to your Printify account data. You are responsible for keeping your credentials confidential and for any activity that occurs as a result of sharing or exposing your credentials. You agree to notify us immediately if you believe your credentials have been compromised. Enlightened by Design LLC will store your credentials securely and use them solely for the purpose of operating the monitoring service on your behalf, as described in our Privacy Policy.

Inventory Management

As the shop owner, you retain ultimate responsibility for the accuracy of your product listings and inventory status across all sales platforms. SharkyPOD Monitor is exclusively a monitoring and notification service. It will not update, modify, pause, or remove your customer-facing product listings on your behalf on any platform, including Etsy, Shopify, WooCommerce, or any other storefront.

Upon receiving an out-of-stock alert, it is your responsibility to take appropriate action in a timely manner, including but not limited to pausing affected listings, updating product availability, or contacting your print provider. Enlightened by Design LLC is not liable for any sales of out-of-stock products, resulting customer refunds, chargebacks, platform fees, or penalties incurred as a result of delayed or absent action on your part following receipt of an alert.

Acceptable Use

You agree to use SharkyPOD Monitor solely for its intended purpose of monitoring your own Printify product catalog. You may not use the service to monitor accounts or catalogs belonging to third parties without their express written consent. You agree not to attempt to reverse engineer, copy, resell, or redistribute the service or any component thereof.

Accuracy of Information

You agree to provide accurate and complete information during the onboarding process, including your email address, Printify credentials, and any other information requested. Providing false or inaccurate information may result in immediate termination of your subscription without refund.

Compliance with Third-Party Terms

You are responsible for ensuring that your use of SharkyPOD Monitor complies with Printify's Terms of Service and API Terms, as well as the terms of any sales platform on which you sell products. Enlightened by Design LLC is not responsible for any consequences arising from your violation of third-party terms of service.

3. No Guarantee of Uptime

While Enlightened by Design LLC makes every reasonable effort to ensure that SharkyPOD Monitor operates reliably and on schedule, we do not guarantee uninterrupted, error-free, or continuous operation of the service.

The service monitors your Printify product catalog on a scheduled basis (approximately every 6 hours). As a result, there will be inherent delays between when a variant's availability changes on Printify and when you are notified. Enlightened by Design LLC is not liable for any losses, costs, damages, or expenses arising from:

Use of this service does not transfer any responsibility for inventory accuracy or listing management from the subscriber to Enlightened by Design LLC.

4. Subscription and Cancellation

SharkyPOD Monitor is offered on a recurring subscription basis. We currently offer monthly subscription plans — specific pricing is detailed on our pricing section.

Billing

Subscriptions are billed automatically at the start of each billing period through our payment processor, Stripe, who acts as Merchant of Record for all transactions. By subscribing, you authorize Stripe to charge your payment method on a recurring basis until your subscription is cancelled. You are responsible for ensuring your payment information remains accurate and up to date.

Cancellation

You may cancel your subscription at any time by accessing your billing portal through the link provided in your subscription confirmation email, or by contacting us. Cancellation takes effect at the end of your current billing period. You will continue to receive service until that date. We do not offer prorated refunds for unused portions of a billing period — please review our full Refund Policy.

Failed Payments

If a payment fails, we will attempt to notify you via email. If payment is not successfully collected within seven (7) days of the failed attempt, your subscription may be suspended or cancelled. Reactivating a suspended subscription may require re-completing the onboarding process.

Account Termination

Enlightened by Design LLC reserves the right to suspend or terminate your subscription at any time if you violate these Terms of Service, engage in fraudulent activity, or misuse the service. In the event of termination for cause, no refund will be issued.

5. Changes to the Service

Enlightened by Design LLC reserves the right to modify, update, suspend, or discontinue SharkyPOD Monitor, or any part thereof, at any time and for any reason, including but not limited to technical improvements, changes in third-party services we rely upon (such as Printify's API), or business decisions.

Notice of Material Changes

In the event of a material change to the service — including significant changes to functionality, pricing, or these Terms of Service — we will do our best to provide notice to subscribers via email prior to the change taking effect. Your continued use of the service after the effective date of any change constitutes your acceptance of the updated terms or service modifications.

Pricing Changes

We reserve the right to change subscription pricing at any time. Existing subscribers will be notified of price changes at least thirty (30) days in advance via email. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

Service Discontinuation

In the event that we permanently discontinue SharkyPOD Monitor, we will provide subscribers with written notice via email.

Third-Party Dependencies

SharkyPOD Monitor relies on third-party services including Printify's API and email delivery infrastructure. We are not responsible for changes, outages, or discontinuation of these third-party services that affect the functionality of SharkyPOD Monitor, and such changes do not entitle subscribers to a refund unless the service becomes permanently non-functional as a result.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Enlightened by Design LLC, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to lost profits, lost revenue, lost sales, loss of data, or business interruption, arising out of or related to your use of or inability to use SharkyPOD Monitor, even if Enlightened by Design LLC has been advised of the possibility of such damages.

In no event shall Enlightened by Design LLC's total cumulative liability to you for any claims arising out of or related to this service exceed the total amount paid by you to Enlightened by Design LLC in the three (3) calendar months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

7. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Informal Resolution First

Before initiating any formal dispute, you agree to contact us and provide a written description of the dispute, your desired resolution, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may proceed to arbitration as described below.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of SharkyPOD Monitor that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in the state in which Enlightened by Design LLC is registered (New Jersey), unless both parties agree otherwise.

No Class Actions

You agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive any right to bring or participate in a class action, collective action, or representative proceeding of any kind. Claims may not be consolidated with those of any other person or entity without the express written consent of Enlightened by Design LLC.

Exceptions

Notwithstanding the above, either party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or other proprietary rights.

Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the state in which Enlightened by Design LLC is registered (New Jersey), without regard to its conflict of law provisions.

Indemnification

You agree to indemnify, defend, and hold harmless Enlightened by Design LLC, its owners, employees, contractors, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the service, your violation of these Terms, your violation of any third-party rights including Printify's Terms of Service, or your provision of inaccurate or fraudulent information during onboarding.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

8. Surviving Provisions

The following sections of these Terms shall survive the expiration, cancellation, or termination of your subscription or this agreement for any reason: Section 2 (Your Responsibilities — Acceptable Use), Section 6 (Limitation of Liability), Section 7 (Dispute Resolution and Arbitration), and any indemnification obligations you have incurred prior to termination. Any other provisions that by their nature are intended to survive termination shall also remain in full force and effect.
